Stratagems as universal formula of the China law

Abstract

У цій статті пояснюється кантіанська «таємниця права» правової політики Китаю. Наведено концепцію давнього коріння стратегем, формулу контексту модернізації, що здійснюється в Китаї. У зв'язку з цим, розкриваючий аналіз правової політики у сфері прав інтелектуальної власності, фінансування видобутку корисних копалин Китаю дає ключ до сучасної державної стратегії модернізації низки східних країн (Японія, Південна Корея, Сінгапур, Індія тощо) та чітко демонструє новий шлях суспільного розвитку, новий шлях модернізації, що базується на синтезі принципів західної технократичної культури з духовними традиціями власної культури зі збереженням національної ідентичності та цивілізаційної ідентичності. This article explains the Kantian "mystery of law" of China's legal policy. The concept of the ancient roots of strategism, the formula of the context of modernization being carried out in China, is presented. In this regard, the revealing analysis of legal policy in the field of intellectual property rights, financing of mineral extraction in China provides the key to the modern state modernization strategy of a number of eastern countries (Japan, South Korea, Singapore, India, etc.) and clearly demonstrates a new path of social development, a new path of modernization, based on the synthesis of the principles of Western technocratic culture with the spiritual traditions of its own culture while preserving national identity and civilizational identity.
