Вплив глобалізації та міждержавної інтеграції на сучасний розвиток конституційного права України: теоретико-прикладний аналіз

Abstract

Монографію присвячено дослідженню впливу глобалізації та міждержавної інтеграції на модернізацію конституційного права в цілому і окремих його інститутів, та методології дослідження, висвітленню особливостей формування предмету та принципів конституційно-правового регулювання. Досліджено онтологічне визначення і співвідношення сучасного конституціоналізму і конституційного права в умовах активізації глобалізаційних процесів. Запропоновано авторське визначення поняття конституційної реформи, яку слід розглядати як поетапне, системне, проведене з дотриманням процедурних вимог внесення якісних, докорінних змін до чинної конституції або прийняття нової конституції, що визнана (легітимізована) суспільством. Визначено феноменологію взаємодії конституційного та міжнародного правопорядків як фактор розвитку конституційного права. Також визначено основні тенденції трансформації галузі конституційного права та її окремих інститутів під впливом сучасних процесів правової глобалізації та міждержавної інтеграції. The monograph is devoted to the study of the influence of globalization and interstate integration on the modernization of constitutional law in general and its individual institutions, and the methodology of the study, highlighting the features of the formation of the subject and principles of constitutional and legal regulation. The ontological definition and correlation of modern constitutionalism and constitutional law in the context of the intensification of globalization processes are studied. The author's definition of the concept of constitutional reform is proposed, which should be considered as a phased, systematic, carried out in compliance with procedural requirements of introducing qualitative, fundamental changes to the current constitution or the adoption of a new constitution that is recognized (legitimized) by society. The phenomenology of the interaction of constitutional and international legal orders as a factor in the development of constitutional law is determined. The main trends in the transformation of the field of constitutional law and its individual institutions under the influence of modern processes of legal globalization and interstate integration are also determined.
