Політико-філософський контекст діалектики прав і свобод людини в умовах сучасної демократизації суспільних відносин

Abstract

В статті визначено, що розуміння прав і свобод людини, їх взаємин сьогодні потребує нового осмислення. Актуалізації даної проблеми пов’язана з глибокими соціальними змінами, зумовленими глобалізацією, світовою інтеграцією, загостренням проблем мультикультуралізму та національного відродження багатьох держав. Підкреслено, що проблема прав і свобод людини багатоаспектна і повинна розглядатися з філософської, політичної, правової точок зору. Під поняттям прав і свобод людини розуміють сукупність соціально обумовлених можливостей індивіда, які дозволяють йому задовольняти свої потреби, зміст яких визначається всією людською природою. В статті зазначається, що що, окрім рівня розвитку самої особистості, при забезпеченні прав і свобод людини вирішальним фактором був і залишається рівень суспільного розвитку. Водночас, права і свободи людини і громадянина не є субстанціями тотожними, а фіксують різні аспекти існування і діяльності індивіда в суспільстві, державі. Демократизація суспільного життя актуалізує питання про свободу людини і, водночас, питання про правове обмеження свободи. При цьому загострюється проблема пошуку необхідного балансу між правами і обов'язками громадян. В статті окреслено певні аспекти діалектики прав і свобод людини в процесі формування демократичної соціальної держави в Україні, що відбувається в межах як світового, так і європейського досвіду. The article defines that the understanding of human rights and freedoms and their relationship today needs a new understanding. Actualization of this problem is connected with profound social changes caused by globalization, world integration, aggravation of the problems of multiculturalism and national revival of many states. It is emphasized that the problem of human rights and freedoms is multifaceted and should be considered from a philosophical, political, and legal point of view. The concept of human rights and freedoms is understood as a set of socially determined capabilities of an individual that allow him to satisfy his needs, the content of which is determined by the whole of human nature. The article states that, in addition to the level of development of the individual, the level of social development was and remains a decisive factor in ensuring human rights and freedoms. At the same time, the rights and freedoms of a person and a citizen are not identical substances, but fix various aspects of an individual's existence and activity in society and the state. The democratization of social life actualizes the issue of human freedom and, at the same time, the issue of legal restriction of freedom. At the same time, the problem of finding the necessary balance between the rights and duties of citizens is becoming more acute. The article outlines certain aspects of the dialectic of human rights and freedoms in the process of forming a democratic social state in Ukraine, which takes place within the limits of both world and European experience.
