Методика розслідування кримінального правопорушення у сфері нерухомого майна, що вчиняється з використанням інформаційно-телекомунікаційних технологій

Abstract

Актуальність дослідження зумовлена інтенсивною цифровою трансформацією суспільства, що суттєво змінює механізм злочинної діяльності, характер доказової інформації та умови здійснення досудового розслідування. На основі узагальнення слідчої практики визначено ключові проблеми розслідування цієї категорії кримінальних правопорушень: мінімізація традиційних матеріальних та ідеальних слідів у зв’язку з дистанційним способом вчинення злочину й електронним документообігом; складність встановлення та викриття учасників шахрайських схем через використання технологій анонімізації та IP-телефонії; проблемність визначення місця закінчення злочину; значний обсяг документації та множинність джерел доказової інформації; необхідність активного залучення спеціальних знань у сфері ІТ і цифрової криміналістики. The relevance of the study stems from the rapid digital transformation of society, which is significantly altering the mechanisms of criminal activity, the nature of evidentiary information, and the conditions for conducting pre-trial investigations. Based on a synthesis of investigative practice, the key challenges in investigating this category of criminal offenses have been identified: the minimization of traditional physical and digital traces due to the remote nature of the crime and electronic document flow; the difficulty of identifying and exposing participants in fraudulent schemes through the use of anonymization technologies and IP telephony; the difficulty of determining the location where the crime was committed; the significant volume of documentation and the multiplicity of sources of evidentiary information; the need for active engagement of specialized knowledge in the field of IT and digital forensics.
