Нормативно-правове забезпечення освітніх функцій у сучасній Україні

Abstract

В статті досліджено деліктну проблематику щодо нормативно-правового забезпечення державними органами освітніх процесів у сучасній Україні. Наголошується на наявності функціонування тих заходів, що регулюються системою державних органів та забезпечують динамічний розвиток освіти, реалізацію її урізноманітнених освітніх рівнів. Окремої уваги заслуговує висвітлення проблематики особливостей тенденцій практичної реалізації питань, що стосуються забезпечення якісної освіти громадян та гарантування державою нормативно-правових механізмів надання освітніх функцій у сучасній Україні. Варто зазначити, що особлива увага приділяється впровадженню в освітній процес пропозицій, спрямованих на акумуляцію досвіду європейських стандартів, щодо інноваційних багатоаспектних підходів в системі адміністративно-правового урегулювання освітньої сфери нашої держави. Практичного значення набувають актуальні питання нормативно-правового забезпечення навчання молоді з обмеженими особливими потребами. У сучасному глобалізованому світі актуалізується питання визначення прав людини та її свобод і, безперечно, визначним етапом розвитку нашої правової держави, стало оновлення законодавства положеннями Закону України від 5 вересня 2017 року «Про освіту». Одним із вирішальних кроків в зазначеному напрямку для забезпечення розробки програмного навчання та суттєвих зрушень ситуаційного порядку, виявили себе, як безумовно необхідні положення, визначені наказами МОН України, щодо питань кадрового забезпечення закладів освіти. Водночас, незважаючи на потенційну спрямованість цільового призначення з питань системи низки нормативно-правових актів урегулювання існуючих норм та сукупність послуг і заходів, що гарантують управління освітнього процесу, варто відзначити практичну відсутність законодавчого акту, що передбачає деліктне спрямування правових норм в системі ключових питань індивідуальної визначеності законодавчих ініціатив визначеності інноваційних рішень в освітній галузі, їх обумовленості. The article examines the tort issues related to the regulatory and legal support of educational processes by state bodies in modern Ukraine. It emphasizes the existence of those measures that are regulated by the system of state bodies and ensure the dynamic development of education, the implementation of its diverse educational levels. Special attention is paid to highlighting the issues of the peculiarities of the trends in the practical implementation of issues related to ensuring high-quality education for citizens and guaranteeing the state's regulatory and legal mechanisms for providing educational functions in modern Ukraine. It is worth noting that special attention is paid to the implementation of proposals aimed at accumulating the experience of European standards in the educational process, regarding innovative multi-faceted approaches in the system of administrative and legal regulation of the educational sphere of our state. Actual issues of regulatory and legal support for the education of young people with special needs are gaining practical importance. In the modern globalized world, the issue of defining human rights and freedoms is becoming more relevant, and, undoubtedly, a significant stage in the development of our rule of law state was the updating of legislation by the provisions of the Law of Ukraine of September 5, 2017 “On Education”. One of the decisive steps in this direction to ensure the development of program training and significant changes in the situational order was the absolutely necessary provisions defined by the orders of the Ministry of Education and Science of Ukraine on the issues of staffing educational institutions. At the same time, despite the potential focus of the target designation on the issues of the system of a number of regulatory legal acts regulating existing norms and a set of services and measures that guarantee the management of the educational process, it is worth noting the practical absence of a legislative act that provides for the tort direction of legal norms in the system of key issues of individual certainty of legislative initiatives, certainty of innovative solutions in the educational sector, and their conditionality.
