Застосування Конституції України при здійсненні правосуддя

Abstract

Порушено актуальну в умовах побудови демократичної держави проблему додержання конституційних засад при здійсненні правосуддя. Розглянуто визначальні питання щодо правового забезпечення судовими органами захисту прав, свобод людини і громадянина, законних інтересів суспільства і держави. Надано обґрунтоване визначення правосуддя як правового інституту, який у своїй діяльності має виходити із пріоритету права та інших соціальних норм. The problem of observing constitutional principles in the administration of justice, which is relevant in the conditions of building a democratic state, is raised. The defining issues regarding the legal provision by judicial bodies of the protection of human and citizen rights and freedoms, legitimate interests of society and the state are considered. A well-founded definition of justice as a legal institution, which in its activities should be based on the priority of law and other social norms, is provided.
