Матричний підхід відповідальності в судовій системі

Abstract

У науковій статті розглядається питання відповідальності в судовій системі, зокрема акцентується увага щодо визначення сутності та юридичної природи матриці відповідальності в судочинстві. Узагальнено окремі аспекти матричного підходу відповідальності для забезпечення незалежної процесуальної діяльності суду. Автором окреслено новітні підходи дослідження відповідальності в судочинстві на підставі наукових розробок з питань загально правової відповідальності та відповідальності в управлінському процесі судовою установою. Новий системний підхід відповідальності зумовлений реформуванням судочинства, запровадження нових інформаційних технологій та методів для забезпечення ефективності і прозорості діяльності судів. Тому матрична структура відповідальності необхідна для впорядкування належної процесуальної діяльності судів. Одним з найбільш дотичним до візуалізації певної організаційної форми відповідальності є система розподілу відповідальності, яка дозволяє ілюструвати зв’язки та процесуальні дії суду під час здійснення правосуддя, на всіх його стадіях. На підставі аналізу особливостей форм юридичної відповідальності суспільних наук та матричної відповідальності процесів в розумінні прикладних наук, автором акцентована увага на запровадженні нового методу системи відповідальності судочинства, з врахуванням інформаційних технологій. Поглиблений аналіз категорії відповідальності дозволив обґрунтувати особливості згаданого явища та конкретизувати аспекти відповідальності за допомогою системного планування і управління. Доведена необхідність визначення чітких критеріїв відповідальності у формі якості результативності та показників- індикаторів при запровадженні матричного методу функціонування структури. А також обґрунтована доцільність запровадження матриці контрольних заходів для успішного функціонування судового процесу, за допомогою нових технологій і методик, які врегулюють судовий процес у чіткий механізм дій. The scientific article examines the issue of responsibility in the judicial system, in particular, attention is focused on determining the essence and legal nature of the matrix of responsibility in the judiciary. Some aspects of the matrix approach of responsibility to ensure the independent procedural activity of the court are summarized. The author outlines the latest approaches to the study of responsibility in the judiciary on the basis of scientific developments on issues of general legal responsibility, responsibility in the management process. The new systemic approach to responsibility is due to the reform of the judiciary, the introduction of new information technologies, and methods to ensure the efficiency and transparency of the courts. Therefore, the matrix structure of responsibility is necessary to regulate the proper procedural activity of the courts. One of the most relevant to the visualization of a certain organizational form of responsibility is the system of distribution of responsibility, which allows illustrating the connections and procedural actions of the court during the administration of justice, at all its stages. Based on the analysis of the features of the forms of legal responsibility of social sciences and the matrix responsibility of processes in the understanding of applied sciences, the author focused attention on the introduction of a new method of the judicial responsibility system, taking into account information technologies. An in-depth analysis of the category of responsibility allowed the author to substantiate the peculiarities of the mentioned phenomenon and specify the aspects of responsibility with the help of system planning and management. The need to define clear criteria of responsibility in the form of performance quality and indicators when implementing the matrix method of system functioning is proven.
