Умови легітимізації механізму судового прецеденту (на прикладі сфери страхування)

Abstract

Актуальність дослідження обумовлюється тим, що наразі в Україні склалися достатні передумови для легітимізації судового прецеденту. Щодо об’єктивних передумов, то від цього залежатиме і успішність судової реформи, і якість судочинства в країні, відповідність його європейським вимогам. The relevance of this study stems from the fact that sufficient preconditions for the legitimization of judicial precedent have now emerged in Ukraine. Regarding these objective preconditions, the success of judicial reform, the quality of the judicial process in the country, and its alignment with European standards will all depend on them.
