Становлення Lex Petrolea та Lex Mercatoria в системі джерел енергетичного права

Abstract

Розглянуто низку правових проблем: (1) актуалізуються дискурсивні проблеми можливості використання єдиних норм та звичаїв міжнародної торгівлі паливно-енергетичними ресурсами (далі – ПЕР) як правових норм у договорах суб'єктів паливно-енергетичного комплексу (далі – ПЕК) з іноземними партнерами паралельно з нормами національного цивільного, комерційного та інвестиційного права; (2) відображено процеси виникнення Lex Petrolea як специфічного джерела та арбітражу спорів ПЕК; (3) Lex Petrolea концептуалізується як розвиток традицій Lex Mercatoria в умовах економічної глобалізації та транснаціоналізації права; (4) висувається гіпотеза про те, що Petrolea являє собою прогрес у правовій аргументації, який, однак, не перетворився на зрілий набір правових норм, а як концентроване визначення досвіду арбітражних рішень вплинув на подальшу долю глобального ПЕК. A number of legal problems are considered: (1) the discursive problems of the possibility of using unified norms and customs of international trade in fuel and energy resources (hereinafter referred to as FER) as legal norms in contracts of entities of the fuel and energy complex (hereinafter referred to as FEC) with foreign partners are actualized in parallel with the norms of national civil, commercial and investment law; (2) the processes of the emergence of Lex Petrolea as a specific source and arbitration of FEC disputes are reflected; (3) Lex Petrolea is conceptualized as the development of Lex Mercatoria traditions in the conditions of economic globalization and transnationalization of law; (4) a hypothesis is proposed that Petrolea constitutes progress in legal argumentation, which, however, did not turn into a mature set of legal norms, but as a concentrated definition of the experience of arbitration decisions influenced the further fate of the global FEC.
